REQUEST FOR EXPRESSION OF INTEREST
The valuation and appraisal services have been developing and making progress in their operations and activities over 20 years in Mongolia. Legal environment and related regulations have played an important role in the development of valuation and appraisal services and they should continue to do so in the future. For this reason, in order to accelerate progress towards advancements of operations and activities of Mongolian valuation and appraisal services, the Government has to improve the appraisal related legal environment so that would be consistent with the international standards.
According to the Parliament resolution #11 of 2017, “Main Direction For Improving Mongolian Legal Environment Till 2020”, it states that the Appraisal law and its related regulations should amended, and in addition under the IMF Extended Fund Facility program the Government is responsible for improve and make amendments to the Legal frameworks of Appraisal law.
Moreover, law enforcement practice of this law and its related laws and regulations proves that there some nuances that need to be further improved and aligned with international standards; particularly rights and responsibilities of the professional institutes should be defined clearly.
Therefore, in order to revise the Law in accordance with international best practices (in the Mongolian context) the Ministry of Finance (MOF) is seeking to hire a professional individual national consultant in the review of the existing law; undertake assessment and prepare a concept paper of a draft law in accordance with Article 14 of The Law on Legislation of Mongolia.
OBJECTIVE OF THE ASSIGNMENT
The main objective of a National Individual Consultant is to perform a thorough review of the existing Appraisal law and its related regulations and to provide professional legal advice and assistance to the Financial Market and Insurance Division (“FMID”) and draft revised law amendments for this law and its related regulations.
SCOPE OF THE ASSIGNMENT
The main assignments and associated activities to be undertaken by the Individual National Consultant shall include (but are not limited to) the following:
I. Review and develop amendments to the Appraisal law and its related regulations.
II. Provide support and assistance to the working group with Appraisal law.
III. Recommendations on Institutional arrangements for FMID.
CONTRACT DURATION
The
consultant’s assignment is expected to commence in April 2019. The
duration of the assignment is 5 months.
CONSULTANTS QUALIFICATION, SELECTION CRITERIA
Qualifications and Experience:
The consultant will be selected in accordance with the World Bank’s Procurement Regulations for IPF Borrowers (July 2016).
