A. BACKGROUND

Mongolia received a credit from the International Development Association (IDA) for the Strengthening Fiscal and Financial Stability (SFFS) Project. The Objective of the SFFS Project is to contribute to the Government of Mongolia’s efforts to strengthen fiscal and financial stability and improve the quality of expenditure management. The project is designed with five components: (i) Strengthening Macroeconomic and Fiscal Management; (ii) Improving the Efficiency of Public Financial Management; (iii) Enhancing Financial Sector Stability; (iv) Strengthening the Social Protection System; (v) Project Management and Monitoring. The objectives are to strengthen fiscal responsibility and implement the relevant policy measures; improve fiscal discipline; strengthen the resiliency of the banking system; improve public expenditure quality in social protection; and provide support for Project implementation, coordination, monitoring, and evaluation, including, inter alia, audit arrangements, reporting requirements, procurement, and financial management activities, respectively. Within the objectives of the Component B on improving the efficiency of Public Financial Management, there is a sub-component on strengthening the public financial management institutional capacity. Under this sub-component, the Ministry of Finance (MoF) seeks to advance the public procurement reforms. 

On March 22, 2019, major changes to the Public Procurement Law of Mongolia (PPLM) were approved by the Parliament concerning advance procurement, green procurement, and additional provisions for complaints and domestic preference procedures. In compliance with the PPLM revisions, the MoF has been revising and updating procurement policy documents including standard bidding documents. Currently revised standard bidding documents have incorporated a guide to ensure green procurement and sustainable procurement initiatives in preparing technical specifications of goods, works, and services. Therefore, “Vision-2050", the long-term development policy of Mongolia, integrates indicators to promote sustainable development goals through public procurement. Thus, there is a strong need for standard technical specifications to be used by the procuring entities as benchmarking technical specifications in preparing or procuring varieties of goods, works, and services in compliance with sustainable development goals. 

B. OBJECTIVE OF THE ASSIGNMENT

The objective of this assignment is to prepare standard technical specifications that will be useful for contracting authorities to procure a variety of common goods, works, and services in compliance with sustainable development goals. 

C. SCOPE OF WORK

The consultant will perform the following tasks under the direct supervision of the Head of the Procurement Policy Division of the Legal Department, the MoF:

  1. Review the current legal environment on green procurement and regulatory requirements for developing and utilizing sample technical specifications; 
  2. Based on the review, formulate recommendations for developing standard technical specifications for common goods (most frequently procured items) in compliance with the sustainable development goals; 
  3. Determine a list of the needed standard technical specifications to be developed; 
  4. Develop standard technical specifications for the common goods (most frequently procured items) as agreed with the MoF;
  5. Develop the relevant guidance/regulatory document for approval by the Minister that includes the standard bidding documents and establishes the legal requirements for using them;
  6. Organize consultations with the relevant stakeholders on the standard bidding documents to seek their feedback; 
  7. Ensure inputs/comments/suggestions from the relevant stakeholders to the draft standard technical specifications are incorporated accordingly, where necessary; 
  8. Prepare and submit to the MOF the final package of the guidance/regulatory document as well as the set of standard bidding documents for green procurement for seeking subsequent approvals; and
  9. Carry out any other relevant tasks as reasonably assigned by the MoF.

D. DELIVERABLES 

  1. Review report on the current legal environment and recommendations for developing standard technical specifications in compliance with the sustainable development goals; 
  2. Draft standard technical specifications for the procurable items as agreed by the MoF; 
  3. Results of consultations organized with stakeholders and summary of comments provided; 
  4. Final package of the relevant guidance/regulatory document as well as the set of standard bidding documents; 
  5. Monthly progress reports; and
  6. Final report together with the relevant detailed documents on completion of all tasks.

E. SUPERVISION AND REPORTING

The consultant shall develop a measurable, time-bound, and output-oriented work plan to be approved by the MoF. In accordance with this work plan, the consultant will work on a day-to-day basis with the staff of the MoF under the direct supervision of the Head of the Procurement Policy Division of the Legal Department, the MoF, or a specialist designated by him/her. 

The Head of the Procurement Policy Division of the Legal Department, the MoF, or his/her designated specialist will meet regularly with the consultant to review the progress of the assignment and to resolve any outstanding issues. 

All information provided to the consultant will be regarded as confidential and information shall not be shared with any outside individuals or organizations. 

F. CONTRACT DURATION 

The consultant work is expected to commence in April 2022 with a duration of 11 months. If any task is not completed within the agreed-upon timeline, the consultant should complete the tasks without any additional cost.

G. INSTITUTIONAL ARRANGEMENTS

The Ministry of Finance will provide office space and make available all the required information and reports in public procurement to the consultant. The consultant is expected to communicate and coordinate his/her work with the Head of the Procurement Policy Division of the Legal Department, the MoF, or his designated specialist. 

H. CONSULTANT’S QUALIFICATIONS

To be considered eligible, candidates should meet all the eligibility criteria listed below:

Education: a bachelor’s degree in law or a related field;

Experience: 5 years of relevant work experience in public procurement or public administration, with preferably at least 2 years of relevant experience in developing legal documents and regulations;

Language skills: Mongolian citizen with fluent written skills in Mongolian and good understanding in English;

Other skills: Be proficient in PC-based applications such as Word, Excel, PowerPoint and have excellent web research and navigation skills; Demonstrated professionalism, good judgment, and willingness to work beyond the regular office hours to meet the deadlines and the needs of the position, if necessary; Proven ability to work in national and international contexts; Ability to work with multidisciplinary teams and institutes; Capacity to manage a variety of tasks with minimal supervision.
