With the support of the Strengthening Fiscal and Financial Stability Project, the Ministry of Finance had developed the "Procedure for disclosing a bid awarded a contract to other bidders "and secured approval by Decree No.132 of 2019 of the Minister of Finance. The e-procurement system /www.tender.gov.mn/ is being revamped in light of the implementation of the approved procedure.

This procedure aims to disclose the bidding documents to the bidders and monitor whether the procuring entity has conducted the tender under the relevant law and regulation.

A total of 2,520 entities in 2020 and 3,160 entities as of November 2021 have reviewed the selected bidder's bidding documents and monitored the legality of the procuring entity's decision.

By improving the information transparency, the external monitoring has been enhanced, which has enabled the bidders to file complaints on the client's illegal actions and reduced the delays in the tender process caused by invalid complaints.

What opportunities does the procedure provide the bidders?

Bidders can review the documents submitted by the successful bidder to ensure whether that bidder's bidding document was qualified as the best-evaluated bid and verify that the client's decision was not faulty.

When can bidders review the documents?

Within five working days from the date of the tender result announcement, other unsuccessful bidders may review the non-confidential part of the bidding document of the successful bidder.

What responsibilities does the client have?

The tender evaluation committee established by the client shall publish the tender results accurately, concisely, and clearly in the "E-Procurement System"/www.tender.gov.mn/ on the day of the tender result announcement. The date of publication of the tender results can be seen in the public tender results menu of the "E-Procurement System"/www.tender.gov.mn/.


The information that the bidders must disclose or keep confidential shall be indicated in the bidding document preparation phase.

In the case of traditional or paper form tenders, the client shall be required to disclose the non-confidential part of the bidding documents of the successful bidder based on the formal request.

What if the successful bidder's document is inactive or unable to view in the system?

It is impossible to review the bidding documents if the time has expired or more than 5 working days have passed since the announcement of the bidding results.

However, it is a violation that the submitted bidding documents are completely confidential before the above-mentioned period expires. The bidders may file a complaint with the Ministry of Finance on the ground of the client has awarded the contract to the bidder, whose bidding documents are entirely confidential. Bidders also have the right to file a complaint if the mandatory information in the bidding documents that are not required to be kept secret is submitted as confidential.

Notes:

  • Bidders shall submit their bids in a disclosed manner, except for the personal confidential information of their organization and employees, unless otherwise specified in the bidding documents.
  • The confidential information shall be prepared separately, and the justification for the confidentiality shall be stated on the first page of the bid.
  • It is prohibited to copy or use the bidding materials submitted by the successful bidder for any other purpose, and such actions are punishable by law.

Within the framework of the European Union financed, World Bank managed “Strengthening Governance in Mongolia” project, the Ministry of Finance, in compliance with the “Sustainable Development Vision 2030” and the “Action Program of the Government of Mongolia for 2016-2020”, has approved and implemented the Public Financial Management (PFM) Reform Strategy and the Action Plan for 2018-2022. The overarching objective of the strategy was to improve governance and achieve effective resource allocation and efficient public service delivery. The implementation status of the PFM Action Plan is indicated as “Certain results have been achieved” at the rate of 85 percent.

The Ministry of Finance Mongolia has developed and successfully launched the Intermediate Service Platform (ISP) in 2022 within the framework of the Strengthening Governance in Mongolia Project. The main purpose of the system is to provide a possibility of information /web services/ exchange between the independent systems of the Ministry of Finance and other organizations in a easy and flexible way. In addition, it is solving the issues of overlapping connections and development between many information systems and organizations, transferring them to a unified standard, making it has no complexity, and more secure.
